Terms of Service
The terms that govern your use of AutoMail, the AI cold email platform that writes personalized sequences, protects deliverability, follows up automatically and books meetings. Last updated: June 2026.
Acceptance of these terms
By using automail.ai or signing up for AutoMail, you agree to these terms of service. If you are acting on behalf of an organization, you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use the service. Any connected, production use of AutoMail is also governed by the specific agreement and onboarding documentation established with each customer, which prevails over these website terms where they differ.
What AutoMail is
AutoMail is an AI cold email platform. When connected to your inboxes, CRM and calendar, it writes hyper-personalized email sequences per prospect, protects deliverability with inbox rotation and warm-up, follows up automatically, detects replies and pauses the sequence, and books meetings, to help you fill your pipeline. It runs on top of your existing inboxes and CRM, on a flat monthly fee per workspace, and provides compliance tooling such as one-click unsubscribe, automatic suppression, and configurable sending limits.
The service supports your outbound process. You remain responsible for the prospects you email, your permission basis, the accuracy of your data, and how you communicate with the people you contact. You can review and control your sequences, sending limits, sender identity and messaging.
Your responsibilities
You are responsible for using the service in line with all laws that apply to you, including the CAN-SPAM Act, the General Data Protection Regulation (GDPR), and other applicable email marketing, privacy and consumer protection rules. You agree to only email prospects you have a legitimate basis to contact, to use a real sender identity and a valid physical mailing address, to include a working one-click unsubscribe in every message, to keep your suppression list current and honor opt-outs promptly, and to configure your sending limits responsibly. AutoMail provides compliance tooling to support your program, but you are responsible for your own lists, your permission basis, and the way you run your campaigns. You agree to provide accurate information and to only connect accounts and data you have the right to use.
Acceptable use
AutoMail is intended for legitimate, permission-based business-to-business outbound by companies emailing their own prospects in compliance with applicable law. You agree to use the service responsibly and to comply with all applicable laws, professional standards and codes of conduct.
You agree not to use the service to:
- Email people you do not have a legitimate basis or permission to contact, or contact anyone in ways that break the law, including ignoring unsubscribe requests.
- Disable or circumvent the one-click unsubscribe, suppression, sending-limit or frequency controls, or use the service to deceive the people you email.
- Use purchased or scraped spam lists, deceptive subject lines, falsified sender or header information, or send to recipients without a valid unsubscribe option.
- Submit data you do not have the right to use, or that infringes someone else\'s rights.
- Send prospect lists or other sensitive records through this marketing website, which is not built to receive them.
- Attempt to disrupt, reverse engineer, scrape, or overload the service or circumvent its limits.
- Resell or redistribute the service except under a written agreement with us.
You are responsible for the data you connect and how you use the output. See our Anti-Spam and Acceptable Use Policy for full details.
Your content and data
As between you and us, you keep all rights to the data you submit and to the outputs you receive, including drafted sequences and replies. You grant us only the limited permission needed to provide the service to you. As described in our privacy policy, this website does not connect to your inboxes, CRM or calendar or send your prospect lists. Any handling of prospect lists, message content, replies, suppression and unsubscribe data within a connected, production deployment is governed by your customer agreement.
Accounts and access
You must provide accurate information when you sign up and keep any credentials secure. You are responsible for activity that happens under your account. Tell us promptly if you believe your account or access has been used without your permission.
Plans, billing and refunds
AutoMail is offered on paid plans only, with no free plan, billed as a flat monthly fee per workspace. Additional connected volume beyond your plan is billed at the published rate. All prices and charges are in US dollars. Subscriptions renew automatically, monthly or yearly depending on the term you choose, until cancelled in line with your agreement. Except where required by law or stated in your agreement, payments are non-refundable. The specific commercial terms for your organization are set out in your order or agreement with us, which controls where it differs from this section.
Service availability
We work to keep AutoMail available and performing well, but we do not guarantee uninterrupted access. We may update, change or temporarily suspend features to maintain and improve the service. Service levels for a production deployment, where applicable, are set out in your agreement.
Intellectual property
AutoMail, including its software, models, interface, content and brand, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your agreement. You may not copy, modify, distribute or create derivative works from the service except as expressly permitted. The names of other companies and products referenced on this site are used for identification only and remain the property of their respective owners.
Disclaimers
To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service is error-free or that any specific deliverability, inbox placement, reply rate, number of meetings booked or pipeline outcome will result. We provide tooling to support deliverability and compliance, but we do not guarantee inbox placement, and we do not provide legal advice. You remain responsible for your own legal compliance. The figures shown on this site are typical outcomes, not guarantees.
Limitation of liability
To the maximum extent permitted by law, AutoMail and its team will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law. Our total liability for any claim will not exceed the amount you paid us for the service in the twelve months before the claim, unless your agreement provides otherwise.
Termination
You can stop using the service at any time, subject to your agreement. We may suspend or terminate access if you breach these terms or use the service in a way that risks harm to others or the platform, including non-compliant sending or spam.
Changes to these terms
We may update these terms as the service evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continued use after changes means you accept the updated terms.
Governing law
These terms are governed by the laws of [governing jurisdiction], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where your customer agreement specifies otherwise.
